This user agreement will use language such as "you", "your", "user", and "users" when speaking to the rules governing the user(s) of the www.asnfperformance.com. "A Son Never Forgets Performance" may be referenced as "ASNF", "ASNFP", "ASNFPerformance", "ASNF Performance", "our", "we", or "us". While "www.ASNFPerformance.com" may also be referenced as "website". Products sold by ASNF Performance on the website are manufactured or shipped by other parties known herein as "Manufacturer" or "Vendor".
Please read through our Terms & Conditions completely before utilizing our website.
By continuing to utilize or purchasing from "ASNFPerformance.com" you are agreeing to any and all terms, conditions, and statements as listed in this agreement. If, at any point, you do not agree with an item listed within the Terms & Conditions as laid out below, please do not use this website.
This agreement is subject to change at any time. If a change is made to the website's Terms & Conditions, we will notify you via the e-mail address you have provided on account registration. Continued use of the website constitutes as your agreement to all rules herein as well as any changes which have been made.
Any revisions will be listed with the date they were added following their addition to the document. For ease of access, the last revision date of this document or any related documentation in full will also be listed here: December 11th, 2023.
1. General Conditions & Terms
a. By agreeing to these Terms of Service, you represent that you at least the age of 18. ASNF does not intentionally gather personal information from individuals under 18 years of age. Users below this age threshold must refrain from providing their personal details to us and are barred from using sections of the website that require registration.
b. Usage of any products purchased from ASNFPerformance.com for illegal or unauthorized purposes is prohibited, this also entails any laws in your jurisdiction(including but not limited to copyright laws).
c. A breach or violation of any terms listed within this document will result in an immediate termination of services.
d. ASNF Performance reserves the right to refuse service to anyone for any reason at any time.
2. Shipping, Warranty, Return, and Privacy Policy Agreement(s)
By continuing to utilize the website, you agree to abide by all rules and regulations set within our listed policies in regards to shipping, warranty, return, and privacy. These policies can be found as linked below as well as list in the bottom section of this agreement and are subject to change at any time(any changes will be made to ensure compliance with Federal & Connecticut state laws and regulations governing eCommerce business):
  • Shipping Policies - These policies shall govern all shipping times, rules, and regulations of any purchases made through the website.
  • Warranty Policies - These policies shall govern all warranties regarding products on the website.
  • Return Policies - These policies shall govern all return rules and regulations regarding purchases made on the website.
  • Privacy Policies - These policies shall govern how we collect, utilize, store, and share your information when you use the website in any shape or form.
3. ASNF Services & Supplied Information
a. ASNF provides online services in which you may purchase aftermarket automotive replacement parts and other related products. ASNF does not itself package, ship, manufacture, or install these products. While ASNF makes an attempt to update the information as listed in regards to the automotive products as listed on the website, verifying legitimacy or accuracy of this information is ultimately the users responsibility. Any harm or damages incurred from the use of information found on the website or received directly from a representative of ASNF Performance shall be the sole responsibility of the user.
b. ASNF Performance is not responsible for any costs and direct or incidental damage to your personal property or harm to your person resulting from modifications made with parts from ASNFPerformance.com.
This includes but is not limited to labor costs, installation costs, missed tune appointment costs, or lost wages due to downtime of customer vehicles before, during or following any of the aforementioned processes or policies.
c. By procuring parts from ASNF Performance for vehicle modification, the customer acknowledges and assumes full responsibility/liability for these potential expenses.
d. Some products listed on ASNF Performance are not intended for road use. Road use specifies a motor vehicle registered and/or intended to be used on public roads normally reserved for transporting oneself to and from places. These item pages state this explicitly. ASNF Performance does not condone the usage of such products for on road motor vehicles. Any user utilizing these products installed in or on an on road vehicle accepts full responsibility and liability of doing so.
4. Items Sold on or via Website

a. ASNF provides no guarantees regarding the merchandise, products, and/or services showcased, referenced, or sold on or via the Website, whether currently available or in the future. You acknowledge that ASNF bears no responsibility and is not liable for any concerns related to the merchandise, products, and/or services presented, mentioned, or distributed through the Website.

b. ASNF endeavors to complete all orders but cannot assure the availability of every product listed on the Website. ASNF may cease the sale of any product on the Website at any moment without notice and has the right to restrict order quantities to levels deemed suitable for regular customers. Product prices on the Website, stated in U.S. Dollars, may vary from prices elsewhere due to different circumstances and are valid exclusively within the U.S. These prices exclude shipping and handling costs and any applicable sales taxes, which will be added to your final bill. You are responsible for paying any shipping and handling charges and any state and local sales or use taxes that may be applied to your purchase.

c. ASNF hopes to maintain a Website free of errors but does not claim that all content, including prices and product details, is accurate or comprehensive. Should ASNF find any pricing errors, it will correct them in its system, and the amended price will apply to your order. ASNF reserves the right to cancel any stated offer and to amend any errors, inaccuracies, or omissions at any point, even after an order has been submitted and acknowledged.

5. International Orders

a. ASNF Performance does not knowingly ship packages outside of the United States. For customers living in Alaska, Hawaii, Puerto Rico or the U.S. Virgin islands please contact customer service directly before placing an order so that the proper costs may be evaluated as they pertain to your specific region. Additionally, due to shipping restrictions, some products may not be available to these regions.

b. ASNF Performance is not responsible for packages should you choose to use a third party freight forwarder or exporter to receive product outside of the US. We do not work with freight forwarders or exporters directly.  If you've sent an order from our website to be delivered to one of these services, we will no longer be able to assist in tracking, refunding, or replacing your order. This includes product damaged in transit or lost packages.

c. By using third party services, such as freight forwarders or exporters, users acknowledge that ASNF Performance has no responsibility to ensure a products arrival -or- to issue a refund on that order beyond offering a tracking number once the item has shipped.

6. Loyalty Program

As of the latest update to our Terms & Conditions, we do not currently have any active Loyalty Program. Once our program is enacted, information as to how that program will function will be located here.

7. No Class Actions

In accordance with applicable law, by using ASNFPerformance.com, you relinquish the right to engage in a class action lawsuit against us. This means you agree not to consolidate your claim with those of any other individual or entity, nor to represent others in any legal action or proceeding against ASNFPerformance.

8. Jurisdiction

ASNF does not claim that the materials on the website are suitable, accessible, or lawful in all locations. If you decide to use the website, it is your responsibility to ensure that your use complies with the laws applicable in your location. This Agreement shall be interpreted and governed by the laws of the State of Connecticut, as it applies to agreements wholly executed therein. Any legal action arising from or connected to this Agreement must be filed in a state or federal court located in Hartford, Connecticut. Furthermore, both parties consent to the exclusive jurisdiction and venue of these courts for any such actions.

HOW DO I GET FREE SHIPPING?

Orders amounting to $199 or more qualify for complimentary shipping within the contiguous United States, which can be chosen at checkout. While expedited shipping incurs a cost, we will deduct the amount equivalent to the free shipping from the expedited shipping fee. Please note that this promotion does not apply to Alaska, Hawaii, military addresses, or items that are too bulky for UPS, FedEx, or USPS delivery. If you've ordered an items which must be shipped via "Freight" a customer service representative will contact you directly at the email you have provided to us if any additional information is needed. All items shipped freight will necessitate the customer be home to receive and sign for delivery of the product.

 

ORDER PROCESSING & SHIPPING:

If your order is processed before 12PM EST, we will do our best to ship the item same day IF the item is in stock at our location or one of our warehouses (some exclusions apply). Orders processed between 12PM and 3PM may possibly ship out the same day, if they are in stock at our location. However, there is no guarantee. We also may have an overload of orders or some unforeseen occurrence which may delay shipping. Most orders are shipped within one to two business days and take 5-7 business days to arrive within the continental 48 United States (when Ground Shipping is selected). However, sometimes, products are back ordered or out of stock and therefore will require some additional time to process the order. We will do our best to expedite the process so that the product will ship in a timely manner, as far as it is possible for us to do so.

 

 

TRANSIT TIMES:

The arrival time of your package is mainly determined by the chosen shipping provider and the service tier you select. It's important to remember that the majority of shipping companies do not operate on weekends or significant holidays. Shipping days mentioned by carriers typically refer to business days, which are Monday to Friday, excluding any holidays the carrier observes. For precise delivery timelines, detailed information is often available on the carrier's website, or you can reach out to our customer service team for more specific information. As a general rule, transit times are as follows:

  • Next Day Air - Transit time of 1 Business Day
  • 2nd Day Air - Transit time of 2 Business Days
  • Ground - Transit time of 5-7 Business Days

 

Orders placed for a product that is listed as “On Order” or “Out of Stock”, we will keep your order in our system for up to 60 days and ship the item as soon as it becomes available. Should the item be deemed as "Discontinued" or other unavailable within this time-frame, ASNF Performance reserves the right to cancel your order.

ASNF Performance reserves the right to split your order into multiple shipments without notification in an attempt to try and get your products to you sooner. Orders are normally only split automatically if both orders qualify for free shipping. If you wish to split your order voluntarily due to an out of stock item, please notify our customer service department and be aware that additional shipping charges may apply if both shipments do not qualify for free shipping.

 

PEAK TIME DELAYS:

Peak times for shipping carriers may delay order arrival, if you are waiting on an order you placed during these time-frames please wait additional time before contacting us in regards to any delays you are seeing.

Here are the date ranges considered peak times by ASNF Performance:

  • November 15th-December 8th(Black Friday/Cyber Monday)
  • December 15th-January 8th(Hanukkah/Christmas/Boxing Day/New Years)

 

DAMAGED / LOST SHIPMENT

Should your order suffer damage or go missing while en route, contact our customer service team immediately. Keep all packaging and boxes that came with your order, as they are required for completing a damage claim. ASNF Performance will not be responsible for any claims of damage that are rejected on account of mishandling by the customer.

Please note: An investigation by the shipping carrier must be completed prior to any replacement shipments being sent. This process can take 2 to 4 weeks and is handled by the shipping carrier not ASNF Performance. By letting our customer service team know of your issues right away, you may cut down on that time significantly!

 

ADDRESS CHANGE(S):

ASNF Performance does not allow for the changing of an orders shipping address following successful checkout via our website. However, there are certain times where an addendum may be made to the outgoing address provided there is an obvious typo. If the address provided to us is incorrect, please let our customer service team know immediately here.

Orders made with an incorrect address will need to be cancelled and re-placed through the website. If the order has already shipped, fees may apply to the cancellation. By letting our customer service team know right away those fees could potentially be avoided. So please do so the moment you notice the address on your order is incorrect! This includes but is not limited to labor costs, installation costs, missed tune appointment costs, or lost wages due to downtime of customer vehicles before, during or following any of the aforementioned processes. By procuring parts from ASNF Performance for vehicle modification, the customer acknowledges and assumes full responsibility/liability for these potential expenses. This includes costs accrued due to any late or on-time shipments made by ASNF Performance or it's partners.

After familiarizing yourself with our return guidelines as listed below, please proceed by submitting a Customer Service Request form to initiate the RMA (Return Merchandise Authorization) process. Not following the procedures as outlined below will cause a delay in our processing of your return.

 

30-DAY STANDARD RETURN POLICY

In the absence of a specified return policy, items sold by ASNF Performance are subject to this policy and may be returned for a refund within 30 days of the original purchase date. An RMA Number is mandatory for all returns, and shipping costs remain non-refundable.

Given the inherent risks associated with racing and performance vehicles, we do not accept returns on any products that have been opened, installed, or used in any capacity. All items returned to ASNF Performance or it's partners are subject to inspection upon arrival.

Errors in shipment, damage in transit, or products that require warranty service or replacement are exceptions to our Standard Return Policy and must be assessed on a case-by-case basis by our customer service team. If you believe your product may qualify for a warranty service or replacement, please review our “Warranty Processing” section below.

*Products purchased in kits/combinations must be returned in full; we cannot accept returns of individual parts from kits/combinations.

 

ITEMS NOT ELIGIBLE FOR RETURN - Special Orders & Open Box or Clearance Items

Some items sold by ASNF Performance are final sale and not returnable, especially those offered at reduced prices. No returns or refunds are available for Special Order, Open Box, or Clearance Items, nor do they carry any 30-day warranty or satisfaction guarantee.

Likewise, custom order items or products that are made to order, often deemed special orders, are not eligible for return or exchange. These special orders may necessitate a non-refundable deposit of at least 50%, which will not be refunded in the event of order cancellation, unless the ordered items become unobtainable or discontinued from the manufacturer.

REFUSED/UNDELIVERABLE ORDERS POLICY

Orders that are refused or deemed undeliverable and returned to us will undergo processing as per our standard return procedures, which includes deducting all shipping costs, return freight charges, and any related fees levied by the carrier, from the refund amount. This includes any and all orders which have been cancelled after shipment was already sent, even if tracking has not yet been received by the customer or has yet to show any movement. Refusing a delivery will lead to delays in the return process and could result in additional shipping costs.

CREDIT ON FILE:

ASNF Performance does not offer credit on file.

ASNF Performance does not offer any warranty coverage for defective products purchased from the website. However, most products listed on our website are covered by manufacturer warranty.

If you believe your product is defective and it is listed as carrying a manufacturer warranty, contact us directly through our online form(See "Clutch Warranties" exception below for warranty concerns regarding clutch products).

Please be sure to provide photos of the product and include any relevant information in regards to the product/defect such as install date and any details regarding damages of the part. Not providing this information will delay the warranty procedure as it is necessary for us to assist in beginning your warranty process or assess any installation concerns. ASNF Performance Customer Service will serve as your point of contact with the manufacturer in most cases, however you may also choose to contact the manufacturer directly if preferred.

Clutch Warranties: It is recommended for any potential warranty involving a clutch to contact the manufacturer first as oftentimes they prefer to assist customers directly in regards to any installation or warranty concerns with these products. ASNF Performance is happy to assist in providing any additional information requested per the manufacturer, however first point of contact for customers experiencing clutch issues should be the manufacturer. By contacting the manufacturer directly in these cases, customers will see a quicker resolution for any clutch issues they may face.
